TERMS OF SERVICE
Effective Date: June 6, 2025

By placing an order with La Modeste Gourmande, you agree to the following terms:

1. All Sales Are Final
We do not accept returns, refunds, or exchanges. Every product is final sale.

2. Product Verification
Each item is uniquely marked, timestamped, and photographed before shipping. Photos are sent to you by email before dispatch. This guarantees that the product you receive is the exact one we packed.

3. Transfer of Responsibility
Once a package is accepted by the shipping carrier, all responsibility transfers to you, the buyer. We are not liable for any delay, damage, loss, or theft during transit. All orders include tracking and up to $100 carrier-provided insurance by default.

4. Temperature-Sensitive Products
Some products require refrigeration and are shipped with cold packs. These items can only be shipped via Express service. It is your responsibility to ensure delivery within 48 hours. We are not liable for spoilage due to delay or missed delivery.

5. Shipping Claims
If your order is lost or damaged after shipment, you may contact the carrier directly with the tracking number and the photo proof we provided at the time of shipping.

6. Order Acceptance and Account Information
We reserve the right to refuse any order. You agree to provide accurate and current billing and shipping information. Orders may be cancelled if they appear to be placed by resellers or for fraudulent purposes.

7. Prohibited Use
You agree not to use this site for illegal activities or to harm, misuse, or exploit the service, our content, or other users.

8. Limitation of Liability
Our products are provided “as-is” without warranty. We are not liable for damages, including lost profits, from using our website or services.

9. Governing Law
These terms are governed by the laws of Canada.
